Amended Klamath Hydroelectric Settlement Agreement

The Amended Klamath Hydroelectric Settlement Agreement (KHSA) was amended on April 6, 2016.  The parties to the amended KHSA are:

The Amended KHSA include commitments by the parties to engage in good faith efforts to develop and enter into a subsequent agreement or agreements pertaining to other water, fisheries, land, agriculture, refuge and economic sustainability issues in the Klamath Basin with the goal to complete such agreement or agreements within the next year.

Key provisions of the Amended Klamath Hydroelectric Settlement Agreement

  • Eliminates the role of the Interior Secretary under the original KHSA signed in 2010 in making a determination on whether to remove PacifiCorp’s Klamath River dams. Instead, the amended KHSA places the decision with the Federal Energy Regulatory Commission (FERC).
  • Establishes the terms for removal of PacifiCorp’s dams in 2020 through the established administrative process governed by FERC. This is the same schedule as in the original KHSA.
  • Calls for the amended KHSA to be filed with FERC by July 1, 2016.
  • Provides that the Klamath River Renewal Corporation would receive title to the Klamath River dams currently owned by PacifiCorp and take the actions and steps necessary to decommission and remove the dams.
